CRITTER SITTER OF VA, LLC

These Terms of Service ("Terms") govern your use of the Critter Sitter of VA, LLC website located at www.crittersitterofva.com (the "Site"), Client Portal, and the pet care services we provide (collectively, the "Services"). By accessing the Site, creating an account, scheduling Services, or otherwise using our Services, you agree to these Terms in full. If you do not agree to these Terms, you may not use the Site or Services.

The terms "Critter Sitter of VA, LLC," "CSVA," "Company," "we," "us," and "our" refer to Critter Sitter of VA, LLC, a Virginia limited liability company. "You" and "your" refer to any client, account holder, visitor, or user of the Site or Services.

1. ELIGIBILITY AND ACCEPTANCE

To use the Site or Services, you must:

Be at least eighteen (18) years of age;
Have legal authority to enter into binding agreements; and
Provide accurate and complete information.

By using our Services, you represent and warrant that you meet these requirements. Use of the Site or Services by minors is prohibited.

2. CLIENT ACCOUNTS

To schedule Services, you may be required to create a Client Portal account and provide current and accurate information, including:

Name
Address
Phone number
Email address
Pet information
Emergency contacts
Veterinarian information
Home access instructions
Alarm or security information

You are responsible for maintaining accurate information at all times and for safeguarding your account credentials. You agree to notify Critter Sitter of VA, LLC immediately of any unauthorized access to or use of your account.

3. PET CARE SERVICES

a. Service Requests and Scheduling

All service requests must be submitted through our approved scheduling system or Client Portal. Service requests are subject to availability and are not guaranteed until confirmed by Critter Sitter of VA, LLC. Critter Sitter of VA, LLC reserves the right to decline, modify, or limit requested Services based on staffing, service area limitations, safety concerns, pet behavior, scheduling constraints, weather, emergencies, or other operational factors.

b. Cancellations and Changes

Cancellation requests must be submitted through the Client Portal or directly to Critter Sitter of VA, LLC. Cancellation fees, holiday fees, peak-season fees, and late cancellation policies are governed by the Client Service Agreement and Policies & Procedures in effect at the time of booking. Failure to provide proper cancellation notice may result in charges regardless of whether Services are ultimately used.

c. Pet Health and Behavior

You represent and warrant that:

Your pets are current on legally required vaccinations where applicable;
Your pets are free from known contagious illness unless disclosed;
All behavioral concerns, bite history, aggression, anxiety, escape tendencies, and medical conditions have been fully disclosed;
Your pets are safe to handle under normal professional pet care conditions.

Critter Sitter of VA, LLC reserves the right to refuse or terminate Services if a pet presents a safety concern to staff, other pets, property, or the public. You authorize Critter Sitter of VA, LLC to seek veterinary care in the event of illness, injury, or emergency if reasonable efforts to contact you or your emergency contact are unsuccessful. You are solely responsible for all veterinary costs and related expenses.

d. Home Access and Property Conditions

You authorize Critter Sitter of VA, LLC and its authorized staff to enter your property solely for the purpose of providing scheduled Services. Clients are responsible for providing safe, functional, and reliable access to the property, including:

Keys
Lockboxes
Entry codes
Garage access
Alarm instructions
Gates
Security systems
Functional doors and locks

You agree to promptly notify us of any access changes. Critter Sitter of VA, LLC is not responsible for: malfunctioning locks or alarms; power outages; internet outages affecting smart locks or cameras; unsafe property conditions; weather-related issues; failures caused by third-party systems; or pre-existing damage or conditions.

e. Pet and Property Risks

You acknowledge that pet care services involve inherent and unpredictable risks. While Critter Sitter of VA, LLC exercises reasonable care, we are not responsible for:

Injuries or illness arising from undisclosed medical or behavioral conditions;
Escapes caused by faulty equipment or undisclosed risks;
Pet fights between household pets;
Natural pet behaviors;
Stress-related illness;
Acts beyond our reasonable control.

Clients remain responsible for damage or injury caused by their pets.

f. Policies & Procedures

Client agrees to comply with all Critter Sitter of VA, LLC Policies & Procedures, Service Agreements, scheduling requirements, and Client Portal instructions, all of which are incorporated into these Terms by reference. Policies and procedures may be updated periodically and made available through the Client Portal or Company website.

4. PAYMENT

Payment for Services is due as outlined in your Service Agreement, Policies & Procedures, and/or current rate schedule. By scheduling Services, you authorize Critter Sitter of VA, LLC to charge the payment method on file for:

Approved services;
Holiday fees;
Cancellation fees;
Late fees;
Returned payment fees;
Additional visit fees;
Extended care fees; and
Any other amounts owed under Company policies or agreements.

We accept payment through approved third-party payment processors. Critter Sitter of VA, LLC does not store sensitive payment card information locally. All pricing and fees are subject to change with reasonable advance notice.

5. REFUSAL OR TERMINATION OF SERVICES

Critter Sitter of VA, LLC reserves the right to refuse, suspend, or terminate Services at any time, including but not limited to:

Aggressive or unsafe pet behavior;
Unsafe property conditions;
Incomplete or inaccurate client information;
Failure to comply with Company policies;
Harassment or abusive conduct;
Nonpayment;
Repeated scheduling violations.

Termination may occur without refund where permitted by applicable law.

6. INTELLECTUAL PROPERTY

All Site content, branding, graphics, logos, service descriptions, photographs, videos, written materials, and related intellectual property are owned by or licensed to Critter Sitter of VA, LLC and are protected by applicable copyright, trademark, and intellectual property laws. No content may be copied, reproduced, distributed, modified, or used commercially without prior written permission.

7. THIRD-PARTY SERVICES AND LINKS

The Site and Services may integrate with or link to third-party providers including:

Scheduling platforms;
Payment processors;
Client portals;
Social media platforms;
Analytics providers.

Critter Sitter of VA, LLC is not responsible for third-party websites, services, policies, outages, or security practices.

8. DISCLAIMER OF WARRANTIES

The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, Critter Sitter of VA, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement. We do not guarantee uninterrupted operation of the Site, Client Portal, scheduling systems, or related technologies.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRITTER SITTER OF VA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION:

LOSS OF PROFITS;
LOSS OF BUSINESS;
LOSS OF DATA;
PROPERTY DAMAGE;
VETERINARY EXPENSES;
EMOTIONAL DISTRESS;
INTERRUPTION OF SERVICES.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF: ONE HUNDRED DOLLARS ($100); OR THE TOTAL AMOUNT PAID BY YOU TO CRITTER SITTER OF VA, LLC DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Critter Sitter of VA, LLC and its owners, members, employees, contractors, agents, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from:

Your violation of these Terms;
Your pets;
Your property;
Your misuse of the Site or Services;
Your violation of applicable law;
Your breach of any agreement with Critter Sitter of VA, LLC.

11. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Virginia without regard to conflict-of-law principles. Any legal action or proceeding related to these Terms or Services shall be brought in a court of competent jurisdiction located within the Commonwealth of Virginia.

12. DISPUTE RESOLUTION

The parties agree to attempt good-faith resolution of disputes before initiating litigation. Critter Sitter of VA, LLC may, at its discretion, require mediation or arbitration before court proceedings where permitted by law. The prevailing party in any legal proceeding shall be entitled to recover reasonable attorneys' fees and costs.

13. PRIVACY POLICY

Use of the Site and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. CHANGES TO THESE TERMS

Critter Sitter of VA, LLC reserves the right to modify these Terms at any time. Updated Terms become effective upon posting to the Site or Client Portal. Continued use of the Site or Services after updates constitutes acceptance of the revised Terms.

15. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. WAIVER

Failure to enforce any provision of these Terms shall not constitute a waiver of future enforcement rights.
